Client refers to any individual or business engaging our services.
Service refers to content creation services including UGC, campaign content, and related creative work.
Content refers to all video, photo, written, or creative assets produced by We Create Content.
Website refers to the We Create Content website.

Acceptance of Terms

By engaging our services or using our Website, you agree to be bound by these Terms & Conditions.
If you do not agree, you must not use our Service.

You confirm that you are authorised to act on behalf of your business where applicable.

Scope of Services

We Create Content provides creator-led content services, including but not limited to:

• User-Generated Content (UGC)

• Campaign-based content

• Project-based engagements

• Ongoing or retainer-based support

• Custom content collaborations

All deliverables, timelines, pricing, and usage rights will be outlined in writing prior to commencement.

Client Responsibility

The Client acknowledges and agrees that:

• All content is created based on information, direction, and approvals provided by the Client.

• The Client is solely responsible for how the Content is used, published, promoted, or distributed.

• The Client is responsible for ensuring content complies with:

• advertising standards

• platform policies

• industry regulations

• local, national, or international laws

We Create Content does not provide legal, compliance, or advertising advice.

Limitation of Liability (Critical Clause)

To the maximum extent permitted by law:

We Create Content is not liable for any loss, damage, claim, or liability arising from the use, misuse, or publication of Content.

This includes, but is not limited to:

• loss of revenue or profit

• reputational damage

• platform penalties or bans

• advertising disapprovals

• regulatory or compliance breaches

• third-party claims

Once Content is delivered and approved, all responsibility transfers to the Client.

Our total liability, if any, is strictly limited to the amount paid by the Client for the specific Service giving rise to the claim.

No Performance Guarantees

We do not guarantee:

• engagement

• reach

• conversions

• sales

• audience growth

• algorithm performance

Content performance is influenced by external factors beyond our control, including platform algorithms, ad spend, audience behaviour, and timing.

Indemnification

The Client agrees to indemnify and hold harmless We Create Content from any claims, damages, losses, or expenses arising from:

• the Client’s use of the Content

• claims made by third parties

• breaches of laws, regulations, or platform policies

• misuse or modification of the Content

Intellectual Property & Usage

Unless otherwise agreed in writing:

• The Client is granted usage rights for agreed marketing purposes.

• We Create Content retains the right to display completed work for portfolio, website, and promotional use.

• Raw files remain the property of We Create Content unless transferred by written agreement.
  
  
  

Revisions and Approvals

• Revision limits and timelines are defined per project or agreement.

• Client approval constitutes acceptance of the Content.

Termination

Either party may terminate services with written notice, subject to agreed terms.
All completed work and outstanding invoices remain payable upon termination.

“As Is” Disclaimer

All Services and Content are provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose.

Governing Law

These Terms & Conditions are governed by the laws of Australia.

Changes to These Terms

We Create Content reserves the right to update these Terms at any time.
Continued use of the Service constitutes acceptance of any updated Terms.
